1. Acceptance of these terms

These Terms of Service form the agreement between you and Yes Plumbing And Heating Inc. for the use of this website and for the supply of plumbing and heating services. By requesting a visit, accepting a quote, using the contact form or otherwise instructing us to carry out work, you accept these terms on behalf of yourself and, if you are acting for another person or an organization, on behalf of that party. If you do not agree with any part of these terms, please do not instruct us and let us know so that we can discuss an alternative.

Where a separate written agreement, a formal purchase order or a signed scope of work has been agreed for a particular project, that document takes precedence over these terms to the extent of any conflict. Otherwise these terms apply together with any quote, booking confirmation or invoice we issue. No variation of these terms is effective unless it is recorded in writing and agreed by an authorized representative of Yes Plumbing And Heating Inc.

2. The company and the workshop

Yes Plumbing And Heating Inc. is a plumbing and heating contractor working from 990 Taunton Rd E, Whitby - L1R 3L8, Canada (CA). The business serves Whitby and nearby communities in Ontario with residential and light commercial plumbing work. The workshop is the base from which fittings are prepared, stock is held and job records are kept. Visits are by arrangement and the workshop is not a retail showroom.

References in these terms to we, us and our mean Yes Plumbing And Heating Inc. References to you and your mean the person or organization instructing the work, together with any person who occupies the property and gives access. The person who instructs the work confirms that they are entitled to authorize it at the property.

3. The services we provide

We provide six principal lines of work, described in more detail on the services page of this website: emergency repair callouts, boiler and furnace service, bathroom refit crews, drain cleaning runs, fixture swap days and winter pipe checks. Each line is delivered from the Whitby workshop and is subject to these terms. The services page is a description of scope, not a guarantee that every task described is available at every time or for every property.

We do not provide gas fitting work beyond the scope that our licensed personnel are permitted to perform, and we do not undertake structural alterations, electrical installation or major demolition unless expressly agreed in writing. Where a job requires a trade we do not hold, we will tell you and, if you wish, coordinate a qualified third party. Work performed by a third party is governed by that party terms.

4. Bookings and confirmation

A booking is made when we confirm a date and a time window after a conversation about the request. A message sent through the website is not a confirmed booking until we reply. We aim to confirm within one business day during published hours. A time window is an estimate unless a fixed appointment has been agreed. Traffic, weather, an earlier emergency or an unexpectedly long job can move a window, and we will contact you as soon as we know a change is needed.

Please give us accurate information when booking, including the address, the type of property, the nature of the fault and any access restrictions such as a locked gate, a concierge or a parking permit. If the property is a rental, tell us who will be present and how to reach them. Accurate information helps us send the right fitter and the right parts on the first visit.

5. Emergency callouts

An emergency callout is intended for situations where water is escaping, a heating system has failed in cold weather and creates a risk, or a fitting has failed in a way that threatens the property. The on-call line is reachable at +14849162958. When you call, please describe the problem briefly and state whether you can reach the main stop tap. If you can safely isolate the water before we arrive, please do so and tell us when you have.

Emergency work is charged at the rate disclosed on the call and confirmed before attendance wherever possible. If the situation is urgent and confirming a figure would delay necessary action, we may attend first and explain the charge on site. A callout may result in a temporary repair where a permanent fix requires parts or daylight. A temporary repair is labelled and recorded, and it remains your responsibility to arrange the permanent repair within the time we advise.

6. Quotes and estimates

We may provide a firm quote or a good faith estimate. A firm quote is fixed for the scope and period stated in it and is not varied unless the scope changes or you ask for additional work. An estimate is our best view of the likely cost at the time and may change if the condition of the property, the availability of parts or the extent of the fault turns out to be different from what we could see or were told.

Quotes are based on the information available at the time. Where a survey is needed before a price can be given, we will say so and will not commit to a figure that would be misleading. Unless a quote states otherwise, it excludes sales taxes, permit fees, the cost of specialist access equipment and the cost of making good decoration after our work. Those items will be added only with your agreement.

7. Pricing and payment

Our charges reflect the labor, parts, travel and disposal involved in a job. Payment terms are stated on the invoice. Unless otherwise agreed, a callout is payable on completion and a project is payable in stages according to the schedule in the quote. We accept the payment methods listed on the invoice. We do not accept payment in a form that cannot be traced, because untraceable payment makes a warranty record difficult to maintain for both parties.

Where an invoice remains unpaid after the due date, we may charge interest at the rate permitted by law from the due date until payment is received, and we may suspend further work. If a payment is disputed, please raise the dispute in writing within a reasonable time and pay any undisputed portion. We will work to resolve a disputed amount promptly and in good faith.

The prices shown in any published material are indicative only and may change without notice. A figure becomes binding when it is confirmed in a quote or on a call and accepted by you.

8. Access to the property

You agree to provide safe and reasonable access to the areas where work is required, including the stop tap, the boiler, the meter and any cupboard or loft that contains pipework. Please clear a working area and secure pets before we arrive. If access is not available when we attend, we may be unable to complete the work and may charge a wasted visit fee that reflects the time and travel involved.

Where we need to work in a shared or communal area, you are responsible for obtaining any consent from a landlord, a condominium corporation or a neighbor that is required. We can help with information for a management company or a building manager, but we cannot obtain that consent for you.

9. Client responsibilities

The client is responsible for the property and for anything that affects our safety while we are on site. This includes disclosing known hazards, such as asbestos, lead paint, unstable floors, damp electrical fittings or a concealed flue, and informing us of any special conditions that apply to a listed building or a protected interior. Please also tell us about any previous work, especially work that may not have been done to standard, because an old repair can change the way a new one should be approached.

You agree not to interfere with our tools, equipment or open pipework during a visit, and to keep children and visitors clear of the work area. Where a system needs to remain drained or switched off overnight, we will tell you and you agree to follow the instruction until we return.

10. Parts and materials

We supply parts and materials that are suitable for the intended use and that meet the relevant standards where a standard applies. Where you supply your own part, we will fit it only if it is compatible and safe, and we may decline to fit an item that we judge unsuitable. A part supplied by you is not covered by our workmanship warranty, and a defect in that part is a matter between you and the supplier.

Special order items may require a deposit and may not be returnable once ordered. We will tell you before ordering a non returnable item. Where a part is delayed, we will give you an honest estimate of the new date and, where possible, offer a temporary measure in the meantime.

11. Changes and variations

A job sometimes changes once a wall is open or a system is drained. We will explain the change, the reason for it and the effect on the price or the schedule before we carry it out, and we will ask for your approval where the change is material. If the change is urgent for safety reasons, we will act first, explain immediately and confirm the adjustment in writing afterwards.

You may request additional work during a visit. We will carry it out only if it can be done safely and within the time available, and it will be charged at the agreed rate. Additional work may change the completion time of the visit and we will keep you informed of any effect on the rest of the schedule.

12. Cancellation and rescheduling

You may reschedule or cancel a booking by contacting us as soon as possible. We ask for reasonable notice, which allows the slot to be offered to another client. Where a cancellation is made with very little notice and the fitter has already set out, we may charge for the travel and time involved. Any charge will be explained and will be reasonable in the circumstances.

We may need to reschedule a visit because of an emergency elsewhere, severe weather, a supply failure or the illness of a fitter. In that case we will tell you as early as we can, offer the next available slot and, where appropriate, refer you to another contractor. We will not charge you for a visit we cancel, other than for any special order parts already purchased for you.

13. Safety and hazardous conditions

Safety comes before schedule. If we find a condition that puts a person, a property or our staff at risk, we may stop work, isolate a system and explain what needs to happen before work can continue. Examples include an unsafe flue, a leaking gas connection, exposed wiring near water or a structure that could not safely carry a fixture. We will not resume work while the risk remains unresolved.

We may refuse work that would breach a safety requirement, a building regulation or a manufacturer instruction. A refusal of that kind is not a breach of these terms. We will explain the reason clearly and, where possible, suggest a compliant alternative.

14. Workmanship warranty

We stand behind our work. Where a fault is caused by our workmanship, we will return and correct it within the warranty period stated on the invoice or on the quote. The period runs from the date of completion and applies to the specific work carried out, not to the whole system. Manufacturer warranties on equipment run separately and are governed by the manufacturer terms.

The warranty does not cover normal wear, damage caused by a third party, damage caused by frost where the client did not follow winter protection advice, misuse, a failure of a client supplied part or a problem in a part of the system that was not part of our work. A warranty visit may be chargeable where the fault turns out not to be caused by our work, and we will tell you before carrying out chargeable work.

15. Limitation of liability

To the extent permitted by law, our liability for a claim arising out of the services is limited to the amount paid by you for the work that gave rise to the claim, or to the cost of repairing or redoing that work, at our option. We are not liable for indirect or consequential losses, including lost rent, lost business, loss of profit or the cost of alternative accommodation, unless the law does not allow that exclusion.

Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. Some consumer protection laws in Ontario give rights that cannot be waived; if any part of this section is found to conflict with those rights, the section applies only to the extent permitted.

16. Damage and existing defects

Plumbing work can disturb tiles, sealant, plaster, flooring and cabinetry. Where an existing finish is fragile, we will discuss the approach before starting and, if requested, agree on how the area will be protected. We do not make good decoration or tiling unless a scope of work includes it. The cost of making good after our work is the client responsibility unless it is caused by our negligence.

Where an existing defect is discovered, such as a corroded pipe behind a wall or a joint that was never sealed, the defect belongs to the property and not to our work. We will report it, explain the risk and quote for a repair if you want us to address it. If a defect makes the requested work unsafe or unwise, we may decline to proceed until it is repaired.

17. Use of this website

This website is provided for information and for contacting the business. You agree to use it lawfully and not to attempt to interfere with its operation, to gain unauthorized access to any system, to scrape content at scale, to submit a false enquiry or to use the contact form for spam or unlawful material. We may suspend access or ignore a message that appears to breach this section.

The content of the website is general information about plumbing and heating and is not a substitute for an inspection of a particular property. We do not warrant that every statement is complete or current for your situation, and you should not rely on a general description as a diagnosis. A proper assessment requires a conversation and, usually, a visit.

We try to keep the site available, but we do not guarantee uninterrupted access. The site may be unavailable during maintenance or because of a fault in a third party network.

18. Intellectual property

The text, layout, illustrations and code of this website belong to Yes Plumbing And Heating Inc. or are used with permission. You may view and print pages for your own reference and share a link with another person. You may not copy substantial parts of the site, republish it, resell it or use it to train a commercial system without written permission.

The business name and any logo used on this site are the property of the company. Nothing on the site grants a licence to use them. Third party manuals and documents referenced on the site remain the property of their own publishers and are used under their terms.

19. Complaints and disputes

If something is not right, please tell us early. A complaint should be sent in writing to the address or email on this page and should include the date of the visit, the address and a description of the issue. We will acknowledge it, review the job record and respond within a reasonable time. Where a visit is needed to assess a complaint, we will arrange one.

We prefer to resolve a concern directly and will make a fair offer to correct a fault or to adjust a charge where that is appropriate. If a dispute cannot be resolved by discussion, the parties may agree to mediation before pursuing any other remedy. Nothing in this section prevents either party from using a remedy available under the law at any time.

20. Governing law

These terms are governed by the laws of the province of Ontario and the federal laws of Canada that apply in Ontario. The parties submit to the jurisdiction of the courts of Ontario for the resolution of a dispute, except where a consumer protection law gives a different forum. The contract is made in Ontario, at the workshop address stated above.

If there is a conflict between a provision of these terms and a mandatory provision of Ontario law, the mandatory provision prevails and the remaining terms continue in force.

21. General provisions

If a provision of these terms is found to be invalid or unenforceable, it will be read down or removed to the minimum extent necessary and the rest of the terms will continue to apply. A delay in enforcing a right is not a waiver of that right. A waiver is effective only if it is recorded in writing.

We may update these terms from time to time. The version on this website is the current version and applies to a new booking made after it is published. A booking already accepted is governed by the version in force at the time of acceptance, unless a change is required by law. Our privacy practices are described in the separate Privacy Policy, which should be read with these terms.

These terms, together with any quote, booking confirmation, invoice and the Privacy Policy, form the entire agreement between the parties for the services and supersede any prior discussion on the same subject.

22. Contact details
